These general terms and conditions of use (“the Terms of Use”) regulate access to and use of the website www.logistajoinus.com, a web platform operated by Compañía de Distribución Integral Logista, S.A.U. and its subsidiaries and associated companies (“GRUPO LOGISTA”), which serves as a tool to comprehensively manage the selection processes of all Group companies located in the European Union and to maximise opportunities for registered users (“Logista Job Portal”).

  5. Attempt to access, use and/or manipulate the data of GRUPO LOGISTA’s Logista Job Portal, third party suppliers and other Users;
  6. Reproduce or copy, distribute, publish in any form, transform or modify the content, unless the User has the authorisation of the owner of the corresponding rights or it is legally permitted;
  7. Suppress, conceal or manipulate the notes on intellectual or industrial property rights and other data identifying the rights of GRUPO LOGISTA or third parties incorporated into the content, or the technical protection devices or any information mechanisms that may be inserted into the content;
  8. Obtain or attempt to obtain the content by using means or procedures other than those made available to the User for this purpose or expressly indicated on the website where the content is located or, in general, those commonly used on the Internet as they do not involve a risk of damage or disablement of Logista Job Portal and/or the content;
  9. In particular, and by way of illustration and without limitation, the User agrees not to transmit, disseminate or make available to third parties any information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software or, in general, any kind of material that:
    1. Is in any way contrary to, disregards or infringes fundamental rights and public freedoms recognised in the Constitution, in international treaties and in other legislation;

    5. Induces or may induce an unacceptable state of anxiety or fear;
    6. Induces or incites practices that are dangerous, risky or harmful for health and mental balance;
    7. Is protected by the legislation on intellectual or industrial property and belongs to GRUPO LOGISTA or to third parties, without authorisation for the intended use;
    8. Is contrary to any person’s honour, personal and family privacy or image;
    9. Constitutes any kind of advertising;
    10. Includes any type of virus or program that prevents Logista Job Portal from working normally.

6. Liabilities

GRUPO LOGISTA does not warrant continuous access or correct viewing, downloading or use of the elements and information contained in Logista Job Portal, which may be prevented, hindered or interrupted by factors or circumstances beyond its control.

GRUPO LOGISTA may interrupt the service or immediately terminate the relationship with the User if it detects any use of its Portal or any of the services offered therein that is contrary to these Legal Terms.

GRUPO LOGISTA is not liable for damages, losses, claims or expenses arising from:

Interferences, interruptions, failures, omissions, telephone outages, delays, stoppages or disconnections in the operation of the electronic system caused by deficiencies, overloads and errors in telecommunications lines and networks or any other cause beyond the control of GRUPO LOGISTA;

  1. unlawful intrusions through use of malicious programs of any kind and through any means of communication, such as computer viruses or any others;
  2. misuse of GRUPO LOGISTA’s websites;
  3. security or browsing errors caused by a malfunction of the browser or use of outdated versions of the browser. The administrators of GRUPO LOGISTA reserve the right to withdraw, totally or partially, any content or information present on the website.

GRUPO LOGISTA cannot control use of Logista Job Portal in any way other than that set out in this Legal Notice. Therefore access to Logista Job Portal and proper use of the information contained therein is the responsibility of the person carrying out such actions. GRUPO LOGISTA excludes any liability for damages of any kind arising from improper, illicit or negligent use of services made freely available to site Users. Under no circumstances does access to the website imply any kind of waiver, transfer, licence or total or partial assignment of such rights, unless expressly stated otherwise. This Legal Notice of the website does not confer on Users any other right of use, alteration, exploitation, reproduction, distribution or publication of the website and/or its content other than as expressly provided for herein. GRUPO LOGISTA is the owner of the elements that make up the graphic design of its website, menus, browsing buttons, HTML code, texts, images, textures, graphics and any other content of the website or, in any case, has the relevant authorisation for use of these elements. To use some of the services, Users must first provide certain personal data. The User can review the policy followed for the processing of personal data and its related purposes in the privacidad.

The fact that a person has an active account with Logista Job Portal does not in any way imply approval or acceptance by LOGISTA or GRUPO LOGISTA for the purposes of hiring that person.

9. User account usage policies

The User agrees to use his or her access codes (user name and password) in accordance with the following restrictions:

  • The password chosen by the User may not infringe the rights to honour and image of third parties, nor in any way infringe the industrial and intellectual property rights of third parties.
  • The User account shall be protected by a password.
  • The access codes are confidential and for the exclusive use of the User who holds them. Custody, confidentiality and correct use of the access codes are his or her sole responsibility.
  • The GRUPO LOGISTA companies shall not be liable for any damage that the User or third parties may incur as a result of other people using their password, whether with or without their knowledge.
  • The account is for personal and non-transferable use, and must not be shared with other people: co-workers, friends, family, etc. The User must avoid disclosing his or her password and, as far as possible, typing the password in front of others.
  • The User agrees to immediately inform GRUPO LOGISTA of any unauthorised use of his or her account or any suspected breach of security of which he or she may become aware, and also if he or she believes that his or her password and/or account information has been stolen or otherwise compromised.
  • If it is detected or suspected that the activities of a User account may compromise the integrity and security of the data, access to that account will be temporarily suspended and will be reactivated only after the necessary measures have been taken, at GRUPO LOGISTA’s discretion.

10. Duration and termination

The service provided by Logista Job Portal and the other services are in principle for an indefinite duration. However, GRUPO LOGISTA may terminate or suspend any of the services of the portal. Whenever possible, GRUPO LOGISTA shall announce the termination or suspension of the provision of a specific service.

11. Force majeure

GRUPO LOGISTA shall not be liable in any event of impossibility to provide service if this were due to protracted outages of the electricity supply or telecommunications lines or to social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all cases of force majeure.

12. Applicable law and jurisdiction

Logista Job Portal is operated and controlled by GRUPO LOGISTA from its offices in Spain. Consequently, any issue that may arise from access and/or use of the site will be deemed to be governed and interpreted in accordance with Spanish law.

In the event that the User is domiciled outside Spain, GRUPO LOGISTA and the User submit, with an express waiver of any other jurisdiction, to the competent Courts and Tribunals in the Kingdom of Spain.

One of the key purposes of LOGISTA Job Portal (access via www.logistajoinus.com ), owned by LOGISTA, is to comprehensively manage the selection processes for all Group companies located in the European Union and maximise opportunities for its registered users.

Every time you use LOGISTA Job Portal and we need to access, or you provide us with, any type of information that enables us to identify you ("Personal Data"), by browsing the site and making use of its services or functionalities (register as a user, register as a candidate for an offer, etc.), you will be subject to the Privacy Policy that is in effect at the given time. At LOGISTA Job Portal we shall need to process the following Personal Data:

The source of the Personal Data we process via LOGISTA Job Portal is your direct interaction with LOGISTA Job Portal itself when you fill in the registration form.

We shall use the Personal Data you provide to identify you as a LOGISTA Job Portal user and grant you access to the services, functionalities and applications available to you as a registered user.

3. What is the legal basis for the processing of your data?

The legal basis that allows us to process your Personal Data is your consent, the application of pre-contractual measures (decision-making prior to employment) and the implementation of the terms of use under the Legal Notice that regulates the use of LOGISTA Job Portal.

4. For how long shall we keep your data?

We shall process your Personal Data for as long as your account remains active. We inform you that your registered user account will expire 24 months after you last logged into the site. Before we delete your account, we shall send you a reminder email informing you how to prevent your account from expiring and your data from being deleted.

While we shall process your data only for the time strictly necessary to fulfil the corresponding purpose, we shall store and protect your data for as long as any liability may arise from the processing under the laws and regulations in force at any given time. After any possible action becomes time-barred, we shall delete the personal data.

To fulfil those purposes, it may be necessary for us to communicate or transfer the information you have provided to companies belonging to the LOGISTA Group (whose activities are related to the transport, logistics, and distribution sectors) to the extent that they need access to your Personal Data, because they are directly involved in the selection processes to which you have applied or because it is necessary in accordance with mutual interests and preferences.
  • Service providers that, among other things, support us in technological matters or for the implementation and management of our selection processes.

6. What are your rights when you give us your details?

We undertake to abide by the confidentiality of your personal data and safeguard the exercise of your rights.
