These general terms and conditions of use (“the Terms of Use”) regulate access to and use of the website www.logistajoinus.com, a web platform operated by Compañía de Distribución Integral Logista, S.A.U. and its subsidiaries and associated companies (“GRUPO LOGISTA”), which serves as a tool to comprehensively manage the selection processes of all Group companies located in the European Union and to maximise opportunities for registered users (“Logista Job Portal”).
Logista Job Portal is owned by Compañía de Distribución Integral Logista, S.A.U., with registered office at Leganés (Madrid 28914), C/ Trigo, 39, Polígono Industrial Polvoranca, and on record with the Madrid Companies Registry, at Volume 2892, Folio 183, Section 8, Page number M-35972, with tax identification code (CIF) A 28141307 (“LOGISTA”). The domain name www.logistajoinus.com (the “Website”) is properly registered by LOGISTA, with all safeguards, as provided for in Law 34/2002Julio, 11th July, on Information Society and Electronic Commerce Services. This Legal Notice is fully compliant with current legislation on Data Protection, Electronic Commerce, Intellectual Property and subsidiary provisions.
2. Acceptance of legal terms
Access to Logista Job Portal or use of it in any form implies acceptance of each and every one of the provisions of this Legal Notice and of the Privacy Policy and the Cookie Policy. GRUPO LOGISTA reserves the right to modify them at any time.
Therefore, before using the services provided to users via Logista Job Portal, the User should carefully read this Legal Notice as well as the Privacy Policy and the Cookie Policy.
Use of Logista Job Portal is also subject to all notices, regulations of use and instructions made known to the User by GRUPO LOGISTA and that replace, supplement and/or modify this Legal Notice.

Logista Job Portal www.logistajoinus.com provides Users with access to content, services, information and data (the “content”). GRUPO LOGISTA reserves the right to modify, update, add to, correct or remove at any time, without prior notice, the presentation, configuration and location of the website, as well as the content and services provided by it. Because information updates are not immediate, we suggest that you always check the currency and accuracy of the information, services and content collected on Logista Job Portal.
4. User status
Full and unreserved acceptance of each and every one of the provisions set out in this Legal Notice and in the Privacy Policy and Cookie Policy attributes the status of User of GRUPO LOGISTA’s Logista Job Portal.
If access to certain contents or services requires personal data to be provided, Users must guarantee the truth, accuracy, authenticity and currency of such data. GRUPO LOGISTA shall accord these data the corresponding automated processing according to their nature or purpose, under the terms indicated in the privacidad.
It is also the User’s responsibility to keep all information provided to GRUPO LOGISTA continuously updated so that it reflects, at all times, the User’s real situation. The User undertakes to make appropriate and lawful use of Logista Job Portal and its content and services in accordance with the legislation applicable at any given time, the Legal Notice, generally accepted ethics and good practice and public order. The User must not:

- Cause damage to the physical or logical systems of the Employee Portal, its suppliers or third parties;
- Introduce or spread computer viruses or any other physical or logical systems that may cause damage to the physical or logical systems of GRUPO LOGISTA, its suppliers or third parties;
- Attempt to access, use and/or manipulate the data of GRUPO LOGISTA’s Logista Job Portal, third party suppliers and other Users;
- Reproduce or copy, distribute, publish in any form, transform or modify the content, unless the User has the authorisation of the owner of the corresponding rights or it is legally permitted;
- Suppress, conceal or manipulate the notes on intellectual or industrial property rights and other data identifying the rights of GRUPO LOGISTA or third parties incorporated into the content, or the technical protection devices or any information mechanisms that may be inserted into the content;
- Obtain or attempt to obtain the content by using means or procedures other than those made available to the User for this purpose or expressly indicated on the website where the content is located or, in general, those commonly used on the Internet as they do not involve a risk of damage or disablement of Logista Job Portal and/or the content;

In particular, and by way of illustration and without limitation, the User agrees not to transmit, disseminate or make available to third parties any information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software or, in general, any kind of material that:
- Is in any way contrary to, disregards or infringes fundamental rights and public freedoms recognised in the Constitution, in international treaties and in other legislation;
- Induces, incites or promotes criminal, denigrating, defamatory or violent actions or, in general, actions contrary to the law, ethics, generally accepted good practice or public order;
- Induces, incites or promotes discriminatory actions, attitudes or thoughts on the basis of sex, race, religion, beliefs, age or condition;
- Incorporates, makes available or allows access to products, elements, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, ethics and generally accepted good practice or public order;
- Induces or may induce an unacceptable state of anxiety or fear;
- Induces or incites practices that are dangerous, risky or harmful for health and mental balance;
- Is protected by the legislation on intellectual or industrial property and belongs to GRUPO LOGISTA or to third parties, without authorisation for the intended use;
- Is contrary to any person’s honour, personal and family privacy or image;
- Constitutes any kind of advertising;
- Includes any type of virus or program that prevents Logista Job Portal from working normally.
6. Liabilities
GRUPO LOGISTA does not warrant continuous access or correct viewing, downloading or use of the elements and information contained in Logista Job Portal, which may be prevented, hindered or interrupted by factors or circumstances beyond its control.
GRUPO LOGISTA may interrupt the service or immediately terminate the relationship with the User if it detects any use of its Portal or any of the services offered therein that is contrary to these Legal Terms.
GRUPO LOGISTA is not liable for damages, losses, claims or expenses arising from:
Interferences, interruptions, failures, omissions, telephone outages, delays, stoppages or disconnections in the operation of the electronic system caused by deficiencies, overloads and errors in telecommunications lines and networks or any other cause beyond the control of GRUPO LOGISTA;
- unlawful intrusions through use of malicious programs of any kind and through any means of communication, such as computer viruses or any others;
- misuse of GRUPO LOGISTA’s websites;
- security or browsing errors caused by a malfunction of the browser or use of outdated versions of the browser. The administrators of GRUPO LOGISTA reserve the right to withdraw, totally or partially, any content or information present on the website.
GRUPO LOGISTA cannot control use of Logista Job Portal in any way other than that set out in this Legal Notice. Therefore access to Logista Job Portal and proper use of the information contained therein is the responsibility of the person carrying out such actions. GRUPO LOGISTA excludes any liability for damages of any kind arising from improper, illicit or negligent use of services made freely available to site Users. Further, GRUPO LOGISTA is exempted from any liability for any content or information received as a result of data collection forms, which exist only for the provision of bid request services. On the other hand, in the event of damage or harm caused by illegal or improper use of these services, the User may be sued by GRUPO LOGISTA for the damage or harm caused.
7. Intellectual and industrial property
The User acknowledges and accepts that all brands, trade marks or distinctive signs and all industrial and intellectual property rights in and over the content and/or any other elements inserted in the website are the exclusive property of GRUPO LOGISTA. Under no circumstances does access to the website imply any kind of waiver, transfer, licence or total or partial assignment of such rights, unless expressly stated otherwise. This Legal Notice of the website does not confer on Users any other right of use, alteration, exploitation, reproduction, distribution or publication of the website and/or its content other than as expressly provided for herein. Any other use or exploitation of any rights shall be subject to a prior and express authorisation specifically granted for this purpose by GRUPO LOGISTA.
The content, text, photographs, designs, logos, images, computer programs, source code and, in general, any intellectual creation on Logista Job Portal, as well as the site itself as a whole as a multimedia artistic work, are protected as copyright by intellectual property legislation. GRUPO LOGISTA is the owner of the elements that make up the graphic design of its website, menus, browsing buttons, HTML code, texts, images, textures, graphics and any other content of the website or, in any case, has the relevant authorisation for use of these elements. The content provided on this website may not be reproduced in whole or in part or transmitted or recorded by any information retrieval system in any form or by any means, unless prior written permission is obtained from the Entity.
It is also forbidden to remove, evade or manipulate any GRUPO LOGISTA copyright notice or any technical protection devices or other information mechanisms that the content may contain. The User of Logista Job Portal undertakes to abide by the rights set out above and avoid any action that could infringe them. In any case, GRUPO LOGISTA reserves the right to exercise any means or take any legal action that it may have in defence of its legitimate intellectual and industrial property rights.
8. Data protection
To use some of the services, Users must first provide certain personal data. The User can review the policy followed for the processing of personal data and its related purposes in the privacidad.
The fact that a person has an active account with Logista Job Portal does not in any way imply approval or acceptance by LOGISTA or GRUPO LOGISTA for the purposes of hiring that person.
9. User account usage policies
The User agrees to use his or her access codes (user name and password) in accordance with the following restrictions:
- The password chosen by the User may not infringe the rights to honour and image of third parties, nor in any way infringe the industrial and intellectual property rights of third parties.
- The User account shall be protected by a password.
- The access codes are confidential and for the exclusive use of the User who holds them. Custody, confidentiality and correct use of the access codes are his or her sole responsibility.
- The GRUPO LOGISTA companies shall not be liable for any damage that the User or third parties may incur as a result of other people using their password, whether with or without their knowledge.
- The account is for personal and non-transferable use, and must not be shared with other people: co-workers, friends, family, etc. The User must avoid disclosing his or her password and, as far as possible, typing the password in front of others.
- The User agrees to immediately inform GRUPO LOGISTA of any unauthorised use of his or her account or any suspected breach of security of which he or she may become aware, and also if he or she believes that his or her password and/or account information has been stolen or otherwise compromised.
- If it is detected or suspected that the activities of a User account may compromise the integrity and security of the data, access to that account will be temporarily suspended and will be reactivated only after the necessary measures have been taken, at GRUPO LOGISTA’s discretion.
10. Duration and termination
The service provided by Logista Job Portal and the other services are in principle for an indefinite duration. However, GRUPO LOGISTA may terminate or suspend any of the services of the portal. Whenever possible, GRUPO LOGISTA shall announce the termination or suspension of the provision of a specific service.
11. Force majeure
GRUPO LOGISTA shall not be liable in any event of impossibility to provide service if this were due to protracted outages of the electricity supply or telecommunications lines or to social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all cases of force majeure.
12. Applicable law and jurisdiction
Logista Job Portal is operated and controlled by GRUPO LOGISTA from its offices in Spain. Consequently, any issue that may arise from access and/or use of the site will be deemed to be governed and interpreted in accordance with Spanish law.
In the event that the User is domiciled outside Spain, GRUPO LOGISTA and the User submit, with an express waiver of any other jurisdiction, to the competent Courts and Tribunals in the Kingdom of Spain.
